General Definitions

  • User: The person who enters into the contract, i.e., fills out any application or purchase form, or on whose behalf it is filled out, and/or participates in the class.
  • Booking: The time slot reserved at the time of application or later, with which the User can secure their participation in the Class.
  • Class Ticket: May be valid for one or more Classes as part of a promotion, for which the user must make a Booking at the time of purchase.
  • Pass: May be valid for multiple Classes, for which the user must make a Booking at the time of purchase.
  • Studio and Venue: The building and the room within the building, or the outdoor area, where the Class is held.

2. General Provisions

2.1. The general terms of use for the services provided by Péter Gódi, instructor of Dance Workout (hereinafter: Service Provider) (hereinafter: Service) are contained in the following General Terms and Conditions (hereinafter: GTC).

2.2. By using the Service, the User must accept these GTC.

2.3. The Service Provider is entitled to unilaterally modify these GTC. The modifications will be published by the Service Provider on the www.danceworkout.hu website and will take effect on the day of publication.

3. Content of the Service

3.1. Within the framework of the Service, the Service Provider provides workout classes (hereinafter: Class). The prices, times, and locations of the Classes are published by the Service Provider on the www.danceworkout.hu website.

3.2. Anyone whose health condition permits and who meets the conditions set by the Service Provider may apply for the Classes.

4. Use of the Service

4.1. To use the Service, the User must register through the www.danceworkout.hu website. The scope of personal data to be provided during registration can be found in the Privacy Policy.

4.2. The User must register for the Classes online. Online registration is done through the www.danceworkout.hu website.

4.3. In the case of registration for the Classes, the User must pay the registration fee. The registration fee must be paid in the manner and within the deadline specified by the Service Provider:

4.3.1. All class tickets or passes are available on the www.danceworkout.hu website at the price valid at the time of purchase and can be used for the specified number of classes.

4.3.2. Available payment methods:

4.3.2.1. Cash payment: It is possible to pay in cash in person before or at the latest after the class.

4.3.2.2. Bank transfer: The bank transfer must be completed within 8 days, but no later than the start time of the booked class.

4.3.2.3. Card payment: Through the Revolut Business, Revolut Merchant interface, to be completed immediately after the purchase.

4.3.2.4. Card-link payment: Through the Revolut Business, Revolut.me interface, if the Revolut Merchant payment gateway opened at the time of purchase has expired, or if Revolut Merchant is unavailable.

4.3.2.5. Card payment (Barion): Online card payments are processed through the Barion system. The card details are not transmitted to the merchant. The service provider, Barion Payment Zrt., is an institution supervised by the Central Bank of Hungary (MNB), license number: H-EN-I-1064/2013. During the payment, the User agrees that the following personal data stored in the user database of the Service Provider (Péter Gódi e.v.) at www.danceworkout.hu will be transferred to Barion Payment Zrt. as a data processor. The scope of the transferred data: last name, first name, email address. The purpose of the data processing by the data processor is to successfully carry out payment transactions, confirm transactions, and perform fraud-monitoring to protect users.

5. User Rights and Obligations

5.1. The User is entitled to participate in the Classes, provided they meet the conditions set by the Service Provider and accept the Studio Usage Policy appendix to these GTC.

5.2. The User is also obliged to comply with the house rules of the respective Venue, i.e., as determined by the studio owners, during the Classes.

5.3. The User acknowledges that participation in the on-site classes is at their own risk and of their own free will.

5.4. The Service Provider will do everything possible to prevent injuries and will do everything in their power to ensure that the User performs the exercises correctly.

5.5. It is the User's responsibility to adjust the difficulty and intensity of the exercises to their own physical abilities and to inform the Service Provider if they have difficulty performing any exercise.

5.6. The Service Provider is not liable for any injuries or damages resulting from the User's health condition, physical fitness, or improper performance of the exercises.

5.7. To protect the User's health, it is important to warm up before the workout and to stretch after the workout. In the event of the User's late arrival or early departure, the Service Provider cannot guarantee this, and the User understands and accepts this.

5.8. The User is obliged to inform the Service Provider before performing the exercises about any health problems, injuries, or conditions that may affect their participation in the workout.

5.9 The User is obliged to follow the Service Provider's instructions and to report if they feel unwell during the workout.

6. Service Provider Rights and Obligations

6.1. The Service Provider is entitled to change the time and location of the Classes.

6.2. The Service Provider is entitled to suspend or cancel the Classes if the number of Users does not reach the minimum set by the Service Provider.

6.3. The Service Provider is entitled to exclude the User from the Classes if the User violates the rules set by the Service Provider.

7. Service Fees

7.1. The fees for the Service are available on the www.danceworkout.hu website.

7.2. The Service Provider is entitled to change the prices, but cannot change the price of products already purchased, unless a technical error resulted in the User paying an incorrectly stated price, in which case the Service Provider will inform the affected User in writing within 3 days.

8. Service Term

8.1. The term of the Service is for the duration of the specific Class for which the Booking was made.

9. Refund, Withdrawal, Cancellation, and Modification (On-site Classes)

9.1. Cancellation of the Service by the Service Provider

If an on-site Class is cancelled by the Service Provider (e.g., due to illness or other reasons), the User is entitled to a 100% refund of the paid fee, or, at their discretion, a credit for the session, which can be used for a future, available time slot within the validity period of the purchased Class Ticket or Pass.

9.2. Cancellation or Modification of the Booking by the User

The User is entitled to cancel or modify their booked time slot free of charge in their account on the website, provided they do so at least 2 hours before the start of the Class. In this case, the used session (one session from a Class Ticket or Pass) will be credited, and the User can use it for another available time slot within the validity period of the ticket/pass.

9.3. Late Cancellation and No-Show

If the User initiates the cancellation within 2 hours before the start of the Class, or fails to appear at the booked Class without prior cancellation, the booked session will be considered used. In this case, the Service Provider is unable to credit the session or refund the fee.

9.4. Exclusion of Monetary Refund

The User acknowledges that the fees for purchased Class Tickets and Passes will not be refunded by the Service Provider, except in the case of cancellation by the Service Provider as regulated in section 8.1. In the event of timely cancellation, the User is only entitled to a credit for the session and its subsequent use.

11. Complaints

11.1. Submitting a complaint

In writing: By letter to the Service Provider's postal address: 2660 Balassagyarmat, Madách liget 12/C 2/4, Hungary.  
Orally: In person with the Service Provider at a pre-arranged time after an on-site class.  
By email: To the Service Provider's email address: danceworkouthu@gmail.com

11.2. Content of the complaint

The complaint must include the following information:

  • Name of the complainant
  • Address of the complainant
  • Phone number of the complainant
  • Email address of the complainant
  • Description and reason for the complaint
  • The claim related to the complaint

11.3. Complaint handling procedure

The Service Provider will investigate complaints within 30 days of receipt.  
The Service Provider will respond to the complaint in writing, justifying its decision.  
If the complaint is unfounded, the Service Provider will reject it.  
If the complaint is well-founded, the Service Provider will take the necessary steps to remedy the grievances mentioned in the complaint.  
The Service Provider will archive written complaints and responses for five years.

11.4. Official proceedings

Initiating proceedings with the consumer protection authority.

In case of a full or partial rejection of the User's complaint, based on Government Decree 387/2016. (XII. 2.) on the designation of the consumer protection authority, they can turn to the competent district office for administrative cases at first instance, or the district office of the county seat, and at second instance to the Pest County Government Office with national competence.

11.5. Proceedings before a conciliation body

Initiating proceedings before the territorially competent conciliation body. Based on the Service Provider's registered office, the Nógrád County Conciliation Body is competent:

If the User wishes to avoid a judicial or official dispute, they are entitled to turn to the conciliation body with their complaint regarding the operation of the Website or the activities of the Service Provider. The primary task of the conciliation body is to cooperate in resolving the dispute between the Service Provider and the User, and to create a settlement between the parties.

11.6. Other complaint-related procedural options

In case of a full or partial rejection of the User's complaint, they are also entitled to use the European Union's online dispute resolution platform. Availability: http://ec.europa.eu/odr

Judicial forum:  
If the procedure related to the User's complaint has not been successful, the User is entitled to turn to the competent court to resolve the dispute.

12. Dispute Resolution

12.1. Hungarian law shall govern the settlement of any disputes between the User and the Service Provider.

13. Final Provisions

13.1. These GTC shall be interpreted in accordance with Hungarian law.
